We carry loose THC-A flower!

In states where recreational cannabis is illegal, THC-A is taking the market by storm due to its similarity to Delta-9 Tetrahydrocannabinol. When THC-A is heated up, it undergoes a process that effectively turns it into Delta-9 - the real thing! So, how is this legal?

In December of 2018, the Agriculture Improvement Act was signed into law. This historic legislation is commonly referred to as the "2018 Farm Bill." According to 7 U.S.C. 5940, the term "industrial hemp" refers to any part of the Cannabis Sativa L. pant, whether growing or not, with a Delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis. The first sentence of this bill states: 

"Notwithstanding the Controlled Substance Act (21 U.S.C. 801 et seq.), the Safe and Drug-Free Schools and Communities Act (20 U.S.C. 7101 et seq.), chapter 81 of title 41, United States Code, or any other Federal Law."

The term "notwithstanding" was widely used by the 114th Congress to supersede previous laws that may apply, without going through the process of overturning them. This confirms that hemp cannot be considered "marijuana" under the CSA.

Our THC-A flower contains between 20-35% THC-A, but always less than 0.3% Delta-9. That makes our flower industrial hemp, which is completely legal to possess and sell in Wisconsin, and any state pursuant to the Full Faith and Credit Clause, Article VI, Section 1 of the Constitution, the Supremacy Clause, Article VI, Section 2 of the Constitution, and the Equal Protection Clause, Section 1 of the Fourteenth Amendment.
